Troy E. Hardman brought this suit in equity in the Circuit Court of Randolph County against C. B. Ward, for the purpose of having a certain tax deed, executed on July 24, 1941, from John S. Caplinger, Clerk of the County Court of Randolph County to said Ward annulled and set aside as a cloud upon plaintiff's title and right of ownership in certain real estate, including surface and minerals, described in plaintiff's bill of complaint.
