S. patent No. 2,271,290 issued January 27, 1942 on an application dated September 6, 1940, for a tool such as a putty knife or wall scraper made with an improved type of handle. Plaintiff, a New Jersey corporation, the present owner of this patent, and defendant, a Massachusetts corporation, are both engaged in the manufacture and sale of tools, including putty knives.
