Wilbur Armstrong, the appellant here, was indicted for manslaughter in that on July 3, 1950, he did wilfully, unlawfully and without malice kill one Otis Robinson by shooting him with a gun. A jury returned a verdict of guilty as charged. Motion for a new trial was denied.

Appellant was the owner of a small farm in Tuolumne County where he lived with his wife Lillian and her three small children...
