Appellant was employed by the Department of Agriculture of the State of Idaho. In the course of such employment he was injured on August 28, 1947, under circumstances creating in the J. R. Simplot Company, a third party, a liability to pay damages for such injury. On October 3, 1947, he served notice of injury and claim for compensation on the State Insurance Fund, insurer. Thereafter, the State Insurance Fund voluntarily paid claimant compensation...
