Plaintiff instituted this action in Monroe County Court to recover treble damages against the defendant based upon an alleged rental overcharge for housing accommodations at 86 Hamilton Street, Rochester, N. Y., covering the period from July 18, 1949, to July 17, 1950.

At the close of all the evidence, the court directed a verdict for the plaintiff in the sum of $667.55 for the alleged over-payment of rental, attorney's fees, cost...
