This is an appeal from a judgment for plaintiff in an action to recover the price of a quantity of smelt sold to defendant. The action was tried to the court sitting without a jury. At the conclusion of the evidence the court made findings of fact and conclusions of law. Judgment was entered for the plaintiff in the amount of $999.49, from which the defendant has appealed.
