Defendant in error, to whom we hereinafter refer as defendant, or by name, was accused of crimes by information containing four counts filed in the district court of the City and County of Denver.

In count one he was charged with the completed crime of obtaining the sum of $500 by means of false and fraudulent representations. This count was withdrawn by the prosecution during the progress of the trial...
