This case is before the court upon an appeal taken by appellant from a judgment of the superior court dismissing an action brought by him against respondent arising out of the following situation:

For some years prior to October 9, 1945, respondent had been engaged in wheat raising in Douglas county, and appellant had been in his employ. Respondent owned certain land and necessary farming equipment, and also operated other nearby lands under lease...
