This action was brought by Fred Ptak against the defendant, city of Oklahoma City, to recover a $1,000 fee paid by plaintiff in order to obtain a permit to drill an oil and gas well upon lands owned by the state within the oil drilling zone of the city of Oklahoma City.

At the trial the parties stipulated that plaintiff was the owner of an oil and gas lease executed and issued by the Commissioners of the land Office of the State of Oklahoma...
