Respondent owns the property at the northeast corner of Piedmont and Linda Avenues in Oakland with a two-story building thereon. The ground floor consists of the "Piedmont" moving picture theatre and three stores. On the second floor there are five apartments, one of which is occupied by respondent.

On January 20, 1941, respondent leased the theatre to defendant Gerald Hardy for 15 years ending January...
