The appellant, Ernest Lutes, was charged with first degree forgery. After a plea of not guilty, he was tried before a jury, which found him guilty as charged. At the conclusion of the state's case, a motion in behalf of the appellant for dismissal on the grounds that the state had failed to prove the crime as charged was denied.
