MURCHIE, Chief Justice.

The plaintiff brings this case to this Court, for the second time, on exceptions to the acceptance of a referee's report giving judgment against him. On the first occasion, his exceptions were sustained. Moores v. Inhabitants of Town of Springfield, 144 Me. ___, 64 A.2d 569, 16 A.L.R. 2d 502. This time they must be overruled.
