NULTY, Justice.

This writ of error comes to the law court on exceptions by the plaintiff in error to the ruling of a justice of the superior court in the County of Cumberland dismissing his writ of error.

The plaintiff in error was indicted at the June Term 1949 in the Superior Court for Kennebec County. The indictment charged the crime of rape pursuant to R.S.1944, Chap. 117, Sec. 10, and further alleged and charged, pursuant to the provisions of R.S. 1944...
