BEALS, J.

By an information filed May 4, 1950, in the office of the clerk of the superior court for Island county, the prosecuting attorney of that county charged George W. Fry with the crime of manslaughter, committed as follows:

"He, the said GEORGE W. FRY, in the County of Island, State of Washington, on or about the 21st day of April, 1950, then and there being, did willfully, maliciously remove, damage and destroy an electric transmission line and apparatus...
