The plaintiff in error Perry Hogan, defendant below, was charged by information in Tillman county, Oklahoma, with the offense of unlawful possession of intoxicating liquor in said county on June 30, 1949. A jury was waived and the defendant was tried on said charge by the trial court, found guilty, his punishment fixed at 30 days in jail and $50 fine, and judgment and sentence entered accordingly.

In this appeal the defendant raises but one issue...
