On petition of the City of Panama City, alternative writ of mandamus was directed to the comptroller, commanding him to pay petitioner such sums as are on deposit in the State Treasury which were collected by the State pursuant to Chapter 26320, Acts of 1949, the pertinent parts of which are Sections 210.03 and 210.21, Florida Statutes, F.S.A.

The comptroller moved to quash the alternative writ on the grounds (1) It does not state facts sufficient...
