SOFFEL, J., March 5, 1951.

Defendant, Horace Charpentier, alias Horace Carpentier, was indicted, together with Ben Edelman, at the above term and number, charged with burglary. Ben Edelman plead guilty. Defendant was tried, and the jury returned a verdict of guilty. The case is now before the court on a motion ex parte defendant for a new trial, predicated upon the alleged error of the trial judge in admitting into evidence certain interstate telephone communications...
