The above case is before us upon preliminary objections to plaintiff's amended complaint in assumpsit. The allegations of the complaint are to the effect that plaintiff, as of September 26, 1946, and as of the present time, is the owner of a tract of ground in South Whitehall Township, Lehigh County, Pa.; that on or about September 26, 1946, 20,000 bricks were purchased from defendant corporation to be used in the construction of a dwelling...
