The defendant, Henry Archelaus Perry, was charged by an information filed in the district court of Oklahoma county with the crime of murder allegedly committed upon one Eugene F. McFerran, was tried, convicted of manslaughter in the first degree, and pursuant to the verdict of the jury was sentenced to serve four years in the state penitentiary, and has appealed.

No question as to the sufficiency of the evidence is raised by the appeal but counsel...
