The plaintiff seeks a declaratory judgment under the provisions of Chapter 32-23, RCND 1943, which is a legislative adoption of the first thirteen sections of the Uniform Declaratory Judgments Act. U.L.A., Vol. 9, p. 215. The defendants demurred to the plaintiff's complaint on the ground that it does not state facts sufficient to constitute a cause of action.
