In the indictment herein defendant was charged, in Count 1, with having on September 14, 1949, at Chicago, Illinois, willfully and unlawfully purchased, from a person or persons unknown, a quantity of a certain derivative of opium, to wit, 112 grains of heroin, which said heroin was not then and there in the original stamped packages, nor from the original stamped packages, in violation of Sec. 2553(a), Title 26, U.S.C.A. Count 2 of the indictment...
