This is an action to recover for personal injuries, which the plaintiff alleged in the first count in tort were sustained when he was evicted from the defendant's clubhouse in violation of the duty which it, as an innkeeper, owed to him, and which he alleged in the second count were due to a breach by the defendant of the contract which it had with the plaintiff as its guest.
