BOSLAUGH, Justice.

This action was instituted in the county court of Polk County to recover from appellee the possession of land owned by appellant. The county court found for appellee and dismissed the case. Appellant filed and prosecuted a proceeding in error to the district court. It affirmed the judgment of the county court. Motion of appellant for a new trial was denied and he has appealed.
