The plaintiff in error T.P. Tripp, justice of the peace, defendant below, was charged by information in the district court of Latimer county, Oklahoma, with the crime of embezzlement. He was tried, convicted by a jury, his punishment fixed at 1 year in the penitentiary, and judgment and sentence entered accordingly. From the said judgment and sentence, this appeal has been perfected.
