The defendant in error, C.F. Sandfer, was charged by information filed in the court of common pleas of Tulsa county with the violation of sections 965 and 970, Title 21 O.S.A., the said information, omitting caption and signature, reading:

"That Elmer W. Adams, the duly qualified and acting County Attorney for Tulsa County, Oklahoma, who prosecutes in the name and by authority of the State of Oklahoma, comes now into Court of Common Pleas within...
