The material allegations of the complaint are that plaintiff is an infant; that defendant, Briggs, is the sole trustee of Common School District No. 4 of the Town of Kirkwood, Broome County, New York, and that as such trustee he was charged with the duty of providing for the education of the children in that district, of whom the plaintiff was one, and that defendant as such trustee was in control...
