This is an action for damages brought by Marion Nickelson for personal injuries he received on March 17, 1949, when he was struck by one of the streetcars operated by respondent. The jury returned a verdict for Nickelson in the sum of $5,000 but the trial court sustained respondent's motion for a new trial.
