HAYS, Justice.

This is an action to quiet title to certain described real estate and is the culmination of litigation extending from 1936. Plaintiff claims to be the owner thereof and asserts that the record title of the defendant Carroll H. Perkins, which is based upon a sheriff's deed, executed in April 1938, and confirmed in a quiet title action April 8, 1939, is void. The trial court held otherwise and quieted the title in Perkins and dismissed plaintiff's petition...
