1. The contention of the defendant that the trial court should have charged, without request, the principles of law set forth in ground 3 of the amended motion for new trial, is without merit. The Code, § 38-306, and the extract from Grace v. State, 49 Ga.App. 306 (4) (175 S. E. 384), could not have been beneficial to the defendant.
