This is a civil suit brought by a taxpayer, seeking to recover a Chevrolet truck alleged to be the property of Miller County, Arkansas. The suit was instituted and prosecuted, pursuant to the provisions of Act 193 of 1945, now found in Sec. 17-304 et seq., Ark.Stats.

Hon. Elmer Freeman was County Judge of Miller County for the four year period ending December 31, 1950. The appellee, I. C. Eason, was a Road Supervisor in the employ of Miller...
