Morgan Kimbrough, the appellant, defendant in the court below, upon a judgment rendered by the circuit court of Leflore County on May 25, 1942, against the appellant and in favor of the appellee, for the sum of $92,091.43. A copy of the judgment was filed as an exhibit to the plaintiff's declaration.
