The plaintiff in error, William Cecil Robedeaux, hereinafter referred to as defendant, was charged by information filed in the county court of Kay county, with the offense of operating a motor vehicle while under the influence of intoxicating liquor, was tried before a jury and convicted, but his punishment was left to the court, who assessed the penalty at 90 days confinement in the county jail at Newkirk, to pay a fine of $300 and costs, and that defendant...
