ERVIN, Justice.

The exception to the refusal of the trial court to dismiss the action upon a compulsory nonsuit raises this question at the threshold of the appeal: Was the evidence introduced by plaintiff at the trial sufficient to carry the case to the jury, and to support its finding on the first issue, i.e., that the plaintiff was injured by the actionable negligence of the defendant?
