The plaintiff in error Tommy Atkins, defendant below, was charged by information in the court of common pleas in Tulsa county, Oklahoma, with the offense of possession of intoxicating liquor. He was tried by a jury, convicted, and his punishment fixed at 90 days in the county jail, and to pay a fine of $250; judgment and sentence was entered accordingly, from which this appeal has been perfected.
