BLUME, Justice.

This is an action brought by the plaintiffs against the defendant Bill Clark to recover damages in the sum of FIFTY THOUSAND DOLLARS ($50,000.00) from the defendant on account of the failure of defendant to drill an oil well. A demurrer was filed to the petition on the ground that it fails to state facts sufficient to constitute a cause of action.
