Appellant was indicted jointly with one Harry S. Kopel in three counts, (1) for setting up and keeping "a certain gaming table for the purpose of gaming"; (2) for setting up and keeping "a certain place for the purpose of gaming"; and (3) for unlawfully betting and gambling and wagering money upon the result of a horse race.1 Kopel was acquitted on all counts.
