No. 650.

65 S.E.2d 142 (1951)

233 N.C. 636

STATE v. WOOD.

Supreme Court of North Carolina.

May 23, 1951.

Attorney(s) appearing for the Case

Harry McMullan, Atty. Gen., Ralph Moody, Asst. Atty. Gen., and Charles G. Powell, Jr. Member of Staff, Raleigh, for the State.

John H. Cook, George S. Quillin, Fayetteville, and Everette Doffermyre, Dunn, for defendant appellant.

BARNHILL, Justice.

In its charge the court instructed the jury as follows: "Character testimony, gentlemen of the jury, is substantive testimony; that is, it is different than corroborative testimony. It is testimony that is direct from that person that testifies on the witness stand that a person has a good character and reputation, that is, direct to that point and that you should believe what that witness has testified to, whoever the witness might be."
