The defendant was indicted on charges of breaking and entering with intent to steal and larceny and, after trial, was convicted and sentenced on May 13, 1942, to life imprisonment as an habitual offender under R.S. 2:103-10. He applied to the lower court for a writ of habeas corpus and his application was denied without opinion; in support of his appeal from this action he advances the sole contention...
