This is an action in trespass for damages in the sum of $5,790.42 as to a continuing injury alleged to have been suffered throughout the year 1947. After trial, the jury returned a verdict in favor of the plaintiff and assessed damages in the sum of $3,711 against the defendant. The defendant thereafter moved for a new trial which was denied.
