The defendant, Paul Kobyluk, was charged by an information filed in the district court of Oklahoma county with the crime of assault with intent to kill, allegedly committed on September 15, 1948, by shooting his wife, Palogia Kobyluk, with a twelve gauge double barrel shotgun; was tried, convicted, and given the maximum sentence of ten years in the penitentiary, and has appealed.
