In this action of assumpsit the jury's verdict was in favor of defendant. Plaintiffs filed motions for a new trial and for judgment n.o.v. The motion for a new trial was that the verdict was against the evidence, the weight of the evidence and against the law. The motion for judgment n.o.v. was in the usual form. Argument upon these motions was heard by the court en banc.
