This is an appeal from a judgment in the sum of $3,000 in favor of the plaintiff and against the defendant in an action for personal injuries sustained by plaintiff.

The parties are in substantial agreement as to the circumstances surrounding the causation of plaintiff's injuries. The question of liability is not disputed. On December 24, 1950, plaintiff and several companions were seated at one end...
