Appellant had been a coal miner for more than fifty-nine years; for some time prior to June, 1949 he worked in the mines of appellee Walter Bledsoe Coal Company (hereinafter referred to as Bledsoe). In the last mentioned month he was seventy-one years old and voluntarily retired and accepted a pension from the United Mine Workers Welfare fund.
