The plaintiff in error, Thomas Robert Huckaby, hereinafter referred to as defendant, was charged by information filed in the district court of Tulsa county with the crime of rape in the first degree, was tried before a jury, convicted and his punishment assessed at 35 years in the State Penitentiary at McAlester.
