JONES, J.

The defendant, Eli Horace Ellington, was charged in the common pleas court of Oklahoma county with the offense of unlawful possession of intoxicating liquor; was tried; convicted; and sentenced to pay a fine of $150 and serve 30 days in the county jail; and has appealed.
