Appellee's decedent, Henry Bates, was injured while working for appellant corporation, Elkhorn Coal Company, on the 13th day of May 1948. Both parties had accepted the provisions of the Workmen's Compensation Act. Henry Bates was the operator of a motor used for hauling coal from the mine, and on the day of the accident, while making a trip in the mine, slate fell upon him with the result that he was partially knocked from the motor with his leg...
