These consolidated cases arise out of an automobile accident which occurred on a public highway between Bolivar and Jackson, Tennessee, about midnight October 8, 1949. The appellee's bus, which was proceeding north, ran into a horse on the highway. With the help of a truck driver, the bus driver removed the horse to the right shoulder of the road.
