At approximately 5:00 p. m. on February 16, 1950, a 72 year old pedestrian, Martha Baker, was struck and fatally injured by a truck operated by Willie Wayne Frederick. This truck was owned by and used in the business of Will Frederick, the father and employer of Willie Wayne Frederick. Garth Mays, administrator of the deceased's estate, brought this action against the Fredericks to recover damages to the estate. The Fredericks denied the charge...
