W. H. Wade, Sr., sued Superior Insurance Company. At the close of plaintiff's evidence, the court instructed a verdict for defendant, rendered judgment accordingly, and Wade appealed.

Wade alleged that on October 15, 1949, he was an employee of Mungerville Gin, Incorporated, in the capacity of "president, manager and common laborer;" that as such employee it was his duty to oversee the operation of the gin, check on other employees...
