The plaintiff in error, Robert Chase Simmons, defendant below, was charged by information in the district court of Jackson county with the crime of burglary. It was alleged in substance that on or about December 23, 1948, in Altus, Oklahoma, the defendant and D.J. Hill and George Hill broke in to the C.R. Anthony store, located at 100 N. Main, and stole 18 men's dress suits, 20 men's leather coats, 4 men's topcoats, 4 men's wool mackinaws and 2 men's wool...
